Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazards of being crushed. a.On or about 08/19/03, employees were not utilizing the restraint device provided on two (2) Hyster 50 forklifts. Employee's were exposed to being ejected from the forklift's during tight turns, or being crushed by the forklift in the event of roll over. Among other methods, one feasible and acceptable method to correct this hazard would have been to properly use the restraint systems which were installed on the forklift's.
