Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by silos and/or portions of silos that have the potential for rupturing and/or launching due to being overfilled and/or subjected to excessive internal pressure during filling: (a)On or about August 14, 2003, there was no means to ensure that the square silo was not being overfilled and/or was not being subjected to excessive internal pressure while ground slag was being added to the square silo at pressures of 12 to 15 psi, to prevent the silo from rupturing and/or launching parts such as but not limited to; the metal cap located over the vent for the silo. Acceptable feasible abatement would be to implement a program of silo maintenance to include procedures regarding the design parameters for the silo, capacity of silo, operating parameters of the silo (including the pressure range acceptable during the fills of the silo that truckers would be expected to follow) and procedures to prevent the overfilling and overpressurization of the silo.ressurization
