A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not ensure that restraining devices (i.e. seat belts) were installed on each forklift to restrain the operator in the event of a rollover. (a) 1002 South 54th Avenue Phoenix, AZ 85043: An orange 1990 Toyota forklift, Model# 5FGC25 and Serial# 5FGC25-11394, was not equipped with a seat belt. (b) 1002 South 54th Avenue Phoenix, AZ 85043: A yellow 1992 Hyster forklift, Model# S50XM and Serial# D187V11446V, was not equipped with a seat belt.
