NCGS 95-129(1): the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hoists/cranes that had ot been load tested: a) shipping -- material weighing more than two tons was being lifted and moved daily using a P & H crane with a two ton capacity. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: upgrade this crane to a capacity greater than the heaviest load to be lifted.t
