Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to impalement hazards:
(a)Construction site at I-10 and McDonald Rd, Mobile, Al:  The employer
installed vertical
flat bar in an area ready to pour concrete to use as level markers which
exposed
employees to impalement hazards as they walk / work in this area.  During
the pouring
process of the cement employees would be stepping in / out of raised rebar
which created
a grid which was about 4 - 6 inches above the deck.
Among other methods of abatement is to install wood caps on the exposed
ends at the
time they are installed.
