General-duty citation text
NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each of it's employees, employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to it's employees and which will provide reasonable and adequate protection to the lives, safety or health of it's employees. In applying this paragraph, fundamental distinctions between private and public employment has been recognized: a)Employees are exposed to being struck by falling piece(s) of roof material which could result in serious injury or death. Areas of significant deterioration of roof material and fallen roof material were observed in bays 2, 3, 4, 5, and 6 and in stairway #1. Employees have been instructed not to enter these areas but no durable physical barrier has been erected to prevent employee access to these areas. There are several reasonable and adequate methods to correct the hazard and/or remove the employees from the exposure. These methods include, but are not limited to: a)Make repairs to the damaged sections of the building roof b)Provide a protective covered walkway through the hazardous portion of egress routes from both stairway #1 and stairway #2 through bay 2. Provide a protective covered walkway through the hazardous portion of stairway #1. Prevent employee access to the remainder of bays 2, 3, 4, 5, and 6 by means of a durable physical barrier and hazard warning signage c)Remove all employees from the second floor of the structure at the North end of bay 2 and prevent employee access to bays 2, 3, 4, 5, and 6 by means of a durable physical barrier and hazard warning signage d)Provide a legal means of egress from the second floor of the structure at the North end of bay 2 by an enclosed stairway leading directly to the exterior of the building and prevent employee access to stairways and bays 2, 3, 4, 5, and 6 by means of a durable physical barrier and hazard warning signage.
