North Carolina General Statute 95-129(a) of the Occupational; Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall from hazard. The exposure was probable in that employee was exposed to hazard of falling from elevated platform attached to forklift that operator left unattended. Ref: ANSI B56.1-1969, 603(E) a)Site - On or about 12 August 2003 an employee was working from elevated platform attached to forklift. Forklift operator positioned platform approximately 11 feet above ground level then left forklift unattended. Employee fell from platform to ground below. In the alternative: 29 CFR 1910.178(m)(5)(i): Powered industrial truck was left unattended with load engaging means in raised position.
