NCGS 95-129(01) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employer did not provide appropriate personnel protective equipment (PPE)[Reference 29 CFR 1928(a)(5): a)Migrant farm worker employees mixing and applying pesticides including Kocide 101(copper hydroxide), Dithane M-45(mancozeb), Agrimex 0.15(butylated hydroxytoulene, n- methylpyrrolidone, abamectin), and Ecozin 3EC(Azadirachtin) were not supplied with adequate Personal Protective Equipment as required by the MSDS of the chemical being mixed and applied.
