North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to contact with high voltage power lines (re 29 CFR 1910.333(c)(iii)(A), NFPA 70E-part II, Ch 1, B(2)(i);(2)): a)site-employee allowed the boom of a Schwing 1200/32XL concrete pumper, mounted on a rubber tired wheeled vehicle to come in contact with power lines energized with 115kv, 36.5' from the ground.
