North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment free from recognized hazards that were causing or
likely to cause death or
serious physical harm to employees, in that employees were exposed to
vehicular traffic:
a)McNeil Rd. exit off of Hwy 15-501 Southbound (Sanford, N.C.) - traffic
signs
were not posted on the secondary/service road that ran parallel to the
entrance ramp
where employees were exposed to vehicular traffic while crossing the
street to and
from the work vehicle parked on the left hand side of the road to the
survey site in the
woods.
One feasible and acceptable abatement method, among others, to correct
this hazard is
to provide and require employees to post traffic signs in work zones
indicating "Survey
Crew Ahead", "Work Zone", "Work Ahead", or other messages or to put
flashing
lights on the work vehicle to indicate the presence of employee's work
zones to alert
oncoming motorist before work is commenced.
