North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: a)facility - where a Vital hand chain operated chain hoist (1 ton) was used to lift barrels of waste electrical cords and parts into trucks and the supporting structure was not rated to ensure that the beam, supporting chain and hook were designed to support the hoist and load; the hook that a polyester sling was place on was missing the latch; and frequent and periodic inspections had not been done. REF: ASME B30.16-1998, Overhead Hoists (Underhung). ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO FOLLOW PROCEDURES LISTED IN ASME B30.16-1998, TO INCLUDE ENSURING THAT THE SUPPORTING STRUCTURE IS DESIGNED TO WITHSTAND THE LOAD AND FORCES IMPOSED BY THE HOIST FOR THE RATED LOAD, CONDUCTING INSPECTIONS AND PREVENTATIVE MAINTENANCE OF THE HOIST, CHAINS, AND OTHER EQUIPMENT.E
