North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to damage to the feet due to the lack of protective foot gear (IAW para (c)(1) 13 NCAC 07F.0404): a)throughout facility-protective foot wear was not required nor provided by the employer where employees were constantly exposed to injury due to working around weights exceeding 15 lbs.
