Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish a place of employment which were free from recognized hazards that
were causing or
likely to cause death or serious physical harm to employees in that
employees were exposed to
the recognized hazards of asphyxiation when required to enter confined
spaces while performing
work without the proper evaluation of the space:
a)West CPM, Mechanical Contractor, SUBASE Point Loma, Man-hole at entrance
of
Middle Pier (5000): An employee was observed inside the of a man-hole in
which he was
removing a flange on a steam pipe.  The confined space (man-hole) was 30
inches wide
by 9 feet deep. The confined space the employee entered had not been
evaluated to
determine if the space was a permit required confined space. West CPM,
Mechanical
Contractor is a pipe fitting company who conduct tasks of this sort
routinely and are
required to adhere to the regulations mandated by the Navy and Staff Civil
Engineering.
All contractors conducting construction on Naval installations are
particularly required
to follow the regulations mandated in the Army Corps of Engineers (EM 385)
which
contains detailed instructions on confined space entry.
Employees who enter confined spaces without the proper evaluation could be
seriously injured
and or cause possible death. Among other methods, recognized and feasible
means of abatement
to correct the hazard include, but are not limited to: Full implementation
of the elements
required by the American National Standard Institute (ANSI), standard
Z117.1 (Safety
Requirements for Confined Spaces). On 12/30/03, and at times prior thereto.
