General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while being lifted on a forklift truck without an approved personnel lift platform or any form of fall protection. At this facility and in the truck loading area: Employees loaded and secured materials for shipping while standing on the forks of a powered industrial truck. Employees were not using any form of fall protection or safety platform. While ultimate responsibility for correcting the hazard rests with the employer, given his/her superior knowledge of the work place, feasible and acceptable methods to correct this hazard, among others are: 1. Follow guidelines listed in the American National Standards Institute (ANSI) B56.1, Safety Standard for Powered Industrial Trucks, section 4.17 - Elevating Personnel - with a High Lift Truck designed to elevate personnel and provide the restraining means such as railing, chains, cable, body belt(s) with lanyard(s), or deceleration devices, that are in place and properly used. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations(s).
