Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling hoist parts and /or falling loads: a) Chip Area -- The Dayton 300 pound load rated underhung hoist, model number 4Z358B, was routinely used to lift loads with weights greater than the rated load capacity of the hoist. b). Chip Area -- The Dayton 300 pound load rated underhung hoist, model number 4Z358B, was not subjected to frequent and/or periodic inspection. Among other methods acceptable methods of abatement include but are not limited to: a. Comply with the Dayton Operating Instructions & Parts Manual, Electric Chain Hoists, Models 4Z358B and 4Z811B, page 1, General Safety Information, item 7 and page 2 item 18 which state "Do not lift more than rated capacity.", and pages 3 and 4, Inspections. b. Follow the recommendations of ANSI/ASME 30.16 - 1998, Chapter 16-3.1.2(h) and Chapter 16.2.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling load hazards: a. Chip area -- The "shop made" below the hook lifting device, used on a 300 pound rated Dayton hoist, to lift 345 pound-plus barrels of steel shavings, did not have a nameplate or permanent markings for the identification of manufacture name, lift capacity, or serial number and the lifting device had not received an initial inspection prior to initial use, frequent inspections, nor periodic inspections. b. Above the Shooting Range -- The "shop made" below the hook lifting device, used on a 1000 pound rated Yale hoist, to lift filters and miscellanies materials, did not have a nameplate or permanent markings for the identification of manufacture name, lift capacity, lifter weight (for lifters over 100 pounds), or serial number and the lifting device had not received an initial inspection prior to initial use, frequent inspections, nor periodic inspections. One feasible and acceptable method of abatement, among others, is to comply with the recommendations of American National Standard ANSI/ASME B30.20, 1985, Below-the-Hook Lifting Devices.
