Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed of being struck by running race cars:
a.Twin State Speedway race track - The employer did not ensure that
employees working on the race track did so under safe conditions while
race cars were driven during caution periods on or about August 6,
2004. Employees were exposed to the hazard of being struck by race
cars while clearing the race track and assisting in the alignment of the
race cars on or about August 6, 2004.
ABATEMENT NOTE:
Among other methods, adequate procedures to ensure that employees perform
work
safely on the race track include, but are not limited to:
1.The development, instruction, implementation and adherence to adequate
safe
procedures by employees, race track officials and race car drivers for the
performance of work which is conducted on the race track by employees.
2.The use of a pace car to maintain control of the race cars during all
caution
periods while employees are working on the track.
3.Establish and enforce a top speed for race cars during caution periods
while
employees are working on the track.
4.Establish and enforce a maximum rpm for race cars during caution periods
while employees are working on the track.
5.Mandate that race cars drive in a single file manner during all caution
periods
when employees are working on the track.
6. Use of a vehicle as a barrier to protect employees while they work on
the race
track.
7.Use of a scanner or radio system to alert the race car drivers where
employees
are working on the track.
8. Use of a dash board caution light system within race cars to alert the
race car
drivers of caution periods.
9. Use of an assistant flagman to assist with the implementation of safe
procedures for work on the race track during caution periods.
10. Use of a field flagman to assist with the implementation of safe
procedures for
work on the race track during caution periods.
11. Flagman or assistant flagman communicating the safe route of travel
for race
cars during caution periods while employees are working on the race track.
12. Use of a spotter to warn both the race car and employee working on the
track
of potential hazardous conditions and locations.
13. The installation of additional caution lights.
14. The installation of additional stadium lights to enhance race car
driver
visibility.
15. Prohibit employees from working on the race track during periods when
the
sun creates poor visibility.
16.Prohibit employees from performing duties to which they are not
assigned so race cars do not unexpectedly encounter them on the
race track.
17.Mandate that race cars do not swerve during caution periods
when employees are working on the track.
