Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazard of falling:
a.Twin State Speedway race track - Employees standing in the open back of
the
pick-up truck were not protected from falls while the truck was driven on
the race
track on or about August 10, 2004.
ABATEMENT NOTE:
Among other methods, feasible and acceptable abatement to correct this
hazard would
be to ensure that the vehicle's owner's manual is followed regarding by
not permitting
individuals from riding in the rear of the open bed of the pickup truck.
