Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to the hazard of a fall: a. Jobsite - An employee was exposed to a nine foot fall while working from the inside of the bucket of the front end loader. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement to correct the hazard is to operate the front end loader according to the manufacturer's instructions and/or use a step ladder or scaffold to gain access to the elevated work area in a safe manner.
