Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling:
a.Site - A truck driver engaged in the task of unloading bundled tanks
from the
truck's trailer bed was repeatedly exposed to fall hazards when climbing
up each
bundle of tanks in order to attach rigging to the lifting points on each
bundle,
which was then moved off the trailer bed by the trailer bed-mounted
hydraulic
crane.
ABATEMENT NOTE:  Among other means of abatement, one feasible and
acceptable means
of abatement would be to implement the following process:
(1)  Ensure that trailer straps are in place to keep the load secured; and
(2)  Use a ladder against the secured load to gain access and secure the
rigging to the
load; and
(3)  Climb down the ladder.

were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being crushed and/or struck by falling
loads:
a.Site -  A truck driver was engaged in unloading bundled tanks from the
truck's
trailer bed was exposed to the hazard of being crushed and/or struck by the
unsecured bundle of tanks he was climbing (in order to attach rigging to
its lifting
points for use of the trailer bed-mounted hydraulic crane).
ABATEMENT NOTE:  Among other means of abatement, one feasible and
acceptable means
of abatement would be to implement the following process:
(1)  Ensure that trailer straps are in place to keep the load secured; and
(2)  Use a ladder against the secured load to gain elevation and secure
the rigging to the
load; and
(3)  Climb down; and
(4)  Use the trailer bed-mounted hydraulic crane to remove slack from the
rigging; and
(5)  Clear the unloading areas of other workers; and
(6)  Release the trailer straps; and
(5)  Using the pendant control, operate the trailer bed-mounted hydraulic
crane to remove
the bundle from the trailer and set it on the ground.
b.Site - A truck driver engaged in unloading bundled tanks from the
trailer bed with the
use of the trailer-bed mounted cranes was exposed to the hazard of being
crushed and/or
struck by loads falling from the crane, which had been modified and had an
unknown
load capacity and radius.
(The cited equipment must be tagged in accordance with 29 CFR 1903.19(i).)
ABATEMENT NOTE:  Among other means of abatement, one feasible and
acceptable means of
abatement would be to:
(1)  Ensure that the modifications to the trailer bed-mounted crane are
reviewed relative to the
current volume, per American National Standards Institute (ANSI) B30.5
Section IV; and
(2)  Ensure that a legible load radius chart is present for the trailer
bed-mounted crane, as per
ANSI B30.5 and the crane manufacturer (Palfinger); and
(3)  Ensure that all employees who operate the trailer bed-mounted crane
read, understand and
follow the crane load and work area charts, as per ANSI B30.5 and the
crane manufacturer
(Palfinger); and
(4)  Ensure that the cranes are inspected on frequent and periodic
intervals, as specified by ANSI
B30.5 and the crane manufacturer (Palfinger).
