Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazards due to close railroad track clearances:
(a) #2 Scale Yard and PRR tracks:  On or about February 05, 2005 close
railroad track
clearances were not identified and eliminated nor were employees
instructed of the locations of
close track clearances and removed from the danger zone.  A conductor, who
was providing
head end protection for four railroad cars, was crushed in the close
clearance created between
the railroad car he was riding on and the stationary railroad cars
containing slabs.
Among other methods, one feasible and acceptable means to abate this
hazard is to comply with
the Commonwealth of Pennsylvania "Regulations for Plant Railways";
Allegheny
