Section 27-a(3)(a)(1): The employer did not furnish to each of its employees, employment, and a place of employment which is free from recognized hazards that are causing or are likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety, or health of its employees. In applying this paragraph, fundamental distinctions between private and public sector employment have been recognized. Westchester County Department of Correctional employees were exposed to the hazard of being infected with Mycobacterium tuberculosis through unprotected contact with inmates who were infectious or suspected to be infectious with tuberculosis in that some employees were not provided with TB skin tests annually. Reasonable and adequate abatement methods for reducing this hazard, as recommended by the CDC, include providing these tuberculin skin tests (TST). (See MMWR "Guidelines for Preventing the Transmission of Mycobacterium tuberculosis in Health-Care Facilities, 2005, and MMWR " Guidelines for the Prevention and Control of Tuberculosis in Correctional and Detention Facilities, 2006).
