NYSLL Article 2, Section 27-a(3):  The employer did not furnish to each of
its employees,
employment and a place of employment which was free from recognized
hazards that are causing
or were likely to cause death or serious physical harm to its employees
and which will provide
reasonable and adequate protection to the lives, safety or health of its
employees.  In applying
this paragraph, fundamental distinctions between private and public
employment have been
recognized.
a)Teacher's aides, during the performance of their assigned duties (such
as lifting  physically
challenged students) were exposed to Musculoskeletal disorders.
Musculoskeletal disorders
continue to be one of the leading occupational health problems in the
United States and are often
caused by overexertion when lifting excessive loads and by the cumulative
effect of repeated
patient(physically challenged students) handling tasks such as lifting,
transfering, and
repositioning patients.
Hazard is well recognized by NIOSH, OSHA and other institutions.
During the inspection, school management stated that an employee injured
her neck during a
student lifting.
Reasonable and adequate methods to abate this hazard include, but are not
limited to
(i) implement an educational program for employees who might have an
occupational exposure
(ii) Training - A comprehensive training program to use the assistive
devices
(iii) follow the NIOSH and OSHA recommendations.
