Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to the hazard falling and
becoming trapped in
an unsafe elevator:
7 West 36th Street, New York, N.Y. - 2 Passenger and 1 Freight Elevators
On or about January 30 till present.
The three elevators at the site, used by employees and tenants, have had
numerous safety hazards, such as but not limited to, relays and electronic
components failing, elevator doors not opening, elevator not stopping on
the
floors, elevators dropping by 2 to 3 floors before slowing down, people
being
rescued from the elevators and broken and loose cables.
1)Elevator 1P-13732 Passenger Elevator has had 12 trouble calls this
calendar
year.  The elevator has had doors which did not open, it jumped from
floors,
been stuck on floors and had people stuck in elevator.  The elevator had
violation filed by NYC DOB for a periodic inspection, had an unsatisfactory
yearly inspection and defects found in this years periodic inspection.
2)Elevator 1P-13731 Passenger Elevator has had 4 trouble calls this
calendar
year.  The elevator has gotten stuck on different floors and then dropping,
water on top of the elevator, and the elevator not leaving the lobby.  This
elevator has had a NYC DOB violation for periodic inspection, an
unsatisfactory yearly inspection and a hoist cables break which required
the
FDNY to rescue people from the elevator.
3)Elevator 1P-13733 Freight Elevator has had 5 trouble calls this calendar
year.
The elevator has gotten stuck and contractors had to break lock to get out
of
elevator, the elevator not stopping at the floor level, and door
interlocks not
working.  This elevator has had a NYC DOB violation for a periodic
inspection, an unsatisfactory yearly inspection and defects found during an
periodic inspection.
Among other methods, the following feasible and acceptable method(s) to
correct this hazard
are:
Comply with ANSI Standard A17.3 (2002) section 2.2.4 ventilation of
machine rooms
with natural or mechanical ventilation to avoid overheating of electrical
equipment.
Comply with ANSI Standard A17.1(2000) section 2.19.2.1 protection against
unintended car movement away from landing as a result of failure in the
(a) electric
driving-machine motor, brake, coupling, shaft, or gearing; (b) the control
system and
(c) any other component upon which the speed of the car depends.
Comply with ANSI Standard A17.1(2000) section 8.11.2 periodic test of the
Car such
as but not limited to (a) Door Opening Device; (b) Stop Switches;
Operating Control
Devices; (d) Car Floor Landing Sill; (n) ventilation; (s) Car Ride; and
(u)
Stopping
Accuracy.
NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT
CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN
ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
