Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: For the period of time leading up to May 20, 2004, employees in the slaughter section were exposed to the hazard of being struck by shackles (weighing approximately 30 pounds) falling from the shackle hoist at the second leg station and from the shackle return rail. Employees were thus exposed to possible injuries, including but not limited to, skull fractures, concussion, neck injuries, broken bones and cuts. Among other methods, feasible and acceptable abatement methods to correct these hazards are as follows: 1. Install a guarding system or pan underneath the shackle return rail where it crosses over employee work stations or traffic areas. 2. Install a guard or other mechanism to prevent shackles from falling off of the hoist at the second legger station.
