Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: At the job-site, located at 11621 East FM 40, Acuff, TX 79403, for the period of time up to and including 12/14/06: Employees were exposed to slip and fall hazards while ascending/ descending fixed metal ladders with multiple defects as follows: a) Fixed metal ladders were found with rungs that did not meet the minimum clear width of 16". b) Fixed metal ladders were found where rung spacings exceeded 12" on centers (rung to rung), and rungs that were not uniformly spaced throughout the same length of climb. Some feasible and acceptable means to abate these hazards would be to remove these ladders and install properly designed / built ladders.
