Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Key Fishing & Rental, well # CAG 958 D, Goldsmith, TX. For the period of time up to and including 12/14/05, the employer failed to ensure a reverse unit was equipped with a spark arrestor. American Petroleum Institute (API) Recommended Practice 54, August 1999, states in Paragraph 9.15.3 "Spark arrestors or equivalent equipment shall be provided on all internal combustion engine exhausts located within 100 ft (30.5 m) of the wellbore. Feasible and acceptable abatement would be to ensure API standards are followed.
