Section 5(a)(1) of the Occupational Safety and Health Act of 1910: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Center Point Gin Co., Inc., 3100 W. FM 2306, Levelland, Texas; For the period of time up to and including January 6, 2006, the employer did not provide forklift training according to the OSHA standard. The employees operated a Nissan Forklift, #40, Serial #28207 to load bales of cotton on a flat bed truck. This condition exposed employees to potential struck by hazards which can cause injuries such as but not limited to broken bones and potential death. NOTE: Abatement certification and supporting documentation are required for this item. Under the National Fire Safety Code (NFPA 2006), Article 8.6.1 states " There shall be a written operating procedure plan and operator training relevant to the location of use and type of truck. Under the National Fire Safety Code (NFPA 2006), Article 8.6.2 states" The procedure shall include, as a minimum, the following; (1) Operation limited to trained personnel (2) Cautions where checking or filling tank (3) Action for suspected leak (4) Refueling instructions (5) Emergency items (a) Shutoff fuel valve (b) Correct battery type and position (c) Fire emergency procedures (6) Hazardous location classifications and markings (7) Industrial truck designations and markings One feasible and acceptable abatement method would be to provide forklift training to all employees who operates a forklift. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Center Point Gin Co., Inc., 3100 State Road 2306, Levelland, Texas; For the period of time up to and including, January 6, 2006, the employees were not protected from fall hazards. a) An employees performed work operations such as changing belts, sprockets, chains and bearings on a separator. The employee worked on a platform approximately 20 feet above the upper level without a mid rail. b) An employee performed work operations on a first stage incline cleaner. The employee worked on a catwalk approximately 12 feet above the lower level without a mid rail on the right side. c) An employee performed work operations on a first stage incline cleaner. The employee worked on a catwalk approximately 12 feet above the lower level without a toeboard. Under the American National Standard A12.1 1973, paragraph 7.1 states "A guard railing shall consist of top rail, intermediate rail or equivalent protection, and posts, and shall have vertical height within the range of 36 inches to 42 inches nominal from upper surface of top rail to floor, platform, runway or ramp level. Under the American National Standard A12.1 1973, paragraph 7.4 states " A toeboard shall be a minimum 3-1/2 inches in height and securely fastened in place and with not more than = clearance above floor level One feasible and acceptable abatement method would be to ensure all walking/working surfaces are installed and maintained in accordance with A12.1 of the American National Standards. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Center Point Gin Co., Inc., 3100 W. FM 2306, Levelland, Texas; For the period of time up to and including January 6, 2006, the employer did not ensure that employees were protected from electrical hazards: a) The electric motor starter panel box for Moss #5 had unused openings. b) The electric motor starter panel box for DIA Fan #20-27 had unused openings. Under the National Electric code (NEC 2005), Article 547.5(C)(1) states "Equipment enclosures, boxes, conduit bodies, and fittings installed in areas of building where excessive dust may be present shall be designed to minimize the entrance of dust and shall have no openings (holes for attachment screws) through which dust could enter the enclosure. One feasible and acceptable abatement method would be to ensure that all electrical equipment is installed and maintained in accordance with Articles 547 and 110 of the National Electric Code. NOTE: Abatement certification and supporting documentation are required for this item.

FM 2306, Levelland, Texas; For the period of time up to and including January 6, 2006, the employer did not ensure that the bench grinder wheel was adjusted. a) The work rest was not adjusted closely to the wheel with a maximum opening of one- eighth inch. b) The distance between the wheel periphery and the adjustable tongue exceeded one- fourth inch. Under the American National Standard B7.1-1970, paragraph 3.7 states "Work rests shall be kept adjusted closely to the wheel with a maximum opening of 1/8" to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage. Under the American National Standard B7.1-1970, paragraph 4.4 states"The maximum angular exposure above the horizontal plane of the wheel spindle shall never be exceeded, the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed 1/4 inch. One feasible and acceptable abatement method would be to ensure that the bench grinders are adjusted in accordance with B7.1-1970 of the American nation Standards. NOTE: Abatement certification and supporting documentation are required for this item.
