Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the condition(s) listed below:
Putnam Concrete Company, Inc., 7441 W. 34th Street, Lubbock, Texas; For
the period of
time up to and including April 4, 2006, employees were elevated on an
unsecured 8-foot
ladder inside a Volvo L70C front end loader to gain access to a 1 in 12
pitch roof. The roof
eve was 21 feet above the lower level. This condition exposed employees to
fall hazards.
Under the Volvo Construction Equipment Operating Instructions, Page 53
states "It is
forbidden to sit or stand in an unsuitable place on the machine, i.e. on
the attachment
(bucket, fork, platform etc.) Or any other mounted equipment so that the
operator cannot
handle the machine in a safe way.
Under the Volvo Construction Equipment Operating Instructions, Page 64
states"The bucket
must not be used for transporting or lifting people-as this might lead to
accidents.
Under Construction Industry Manufacturers Association (CIMA), Page 17
states"Never use a
bucket or blade for a work platform or personnel carrier.
One feasible and acceptable abatement method would be to ensure that the
front end loader
bucket is not used to lift employees.
