Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: At the construction site of a Motel 8, located at 6510 & I-27, Lubbock, TX 79413, for the period of time up to and including 03 May 2006: an employee was observed working from (entering and exiting an elevated platform at the eve of the roof of a motel under construction and exposed to 31' fall hazards) and the fork lift was not in plain view, nor was the attendant within 25' of the lift. ANSI B56.1 - 1975, paragraph 603 states "Powered industrial truck operators shall abide by the safety rules and practices in 604, 605, 606 and 607." ANSI B56.1 - 1975, paragraph 604, section E states "When the operator of an industrial truck is dismounted and within 25 feet (7600 mm) of the truck which remains in his view, the load engaging means shall be fully lowered, controls neutralized and brakes set to prevent movement." ANSI B56.1 - 1975, paragraph 604, section F states "A powered industrial truck is unattended when the operator is 25 feet (7600 mm) or more from the truck which remains in his view, or whenever the operator leaves the truck and is not in his view. One feasible and acceptable abatement would be to ensure all employees are trained in and comprehend the ASME/ANSI standards. Note: Abatement certification and supporting documentation are required for this item.
