Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by or crushed-by hazards: a.At Doane Pet Care - On or about September 26, 2003, employees were not utilizing the restraint device provided on the Toyota Forklift. Employees were exposed to being struck-by and crushed-by hazards, in the event of a tip-over or loss of control. Among other methods, one feasible and acceptable method would be to ensure that all forklift operators engage the restraint devices provided on the forklifts.
