Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the rotating blade:
a)Main Shop Area-The Betzinger horizontal bandsaw No model#, was not
equipped with a
magnetic restarter or similar device, as prescribed by American National
Standards Institute
(ANSI) B11.10-1990, Section 5.2.3.4, that in the event of an interruption
in the electrical supply
such a device would prevent the saw from restarting automatically when
power is restored.
b)Main Shop Area-The Betzinger horizontal bandsaw No model#, had exposed
operating
switches (toggle switches) that exposed employees to accidental start-up
of the saw.The
American National Standards Instute (ANSI) B11.10-1990, Section E5.2.3.1
that states
unintended operation may be caused by bumping of the control by the
operator or other
personnel, or by unclear or ambiguous labeling of control devices.
Abatement documentation is required for this item in accordance with the
requirements of
29 CFR 1903.19(d).s
