Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
The employer failed to ensure the workplace was free of recognized hazards
when he chose not
to have metal plate wood trusses properly braced inaccordance to the
requirements set out by
the architect as labeled on hte blueprints or as prescribed by the truss
manufacturer who
provided additonal documentation regarding the proper bracing of wood
trusses.  Consequently,
the trusses fell and forced the collapse of the structure.
The employer could have corrected or prevented the accident had he
accomplished on of the
following:
1. Provided proper bracing to include lateral and diagonal bracing to the
top
chords, lateral
bracing to the bottom chords and diagonal bracing between web members.
2. Ensured the columns to which the trusses where being secured, were
anchored and bolted to
an affixed/permanent footer.
3. Provided proper training to workers to recognized hazards associated
with truss erection.d
