Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazards while riding the lifting forks on
the front of the
forklift to gain access to the working level of the structural steel of
the job site:
Location: 106 W 117 St, New York, N.Y.
On or about 07/21/04.
a)An employee was observed riding the forks of the Lull fork lift machine
to get up to
the second story structural steel (elevation 20 ft). The employee could
fall off or be
caught between the equipment and the structure.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS: Use proper ladders to reach work levels.
Note:  The employer is required to submit abatement certification for this
item in accordance
with 29  CFR 1903.19.
