Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when standing on the midrail of Self-Propelled Elevated Work Platform: (a)New Charter Bank construction site; an employee was observed standing on the midrail of a scissors lift (Snorkel Lift-Model SL 15, Dawes Rental), while in the process of accessing the roof joists. Employee was not utilizing fall protection, and was exposed to a fall hazard of an estimated 12 feet to the deck surface below. Among other methods, feasible and acceptable methods of abatement to correct this hazard would be to comply with American National Standards institute (ANSI) A92.6- 1990, standard for Self-Propelled Elevating Work Platforms, which requires in Section 7.11.1 that personnel shall maintain a firm footing on the platform floor while working thereon. Abatement Certification is required for this item.
