Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazards associated with failing to use seat belt
restraints while
operating a powered industrial truck:
(a)American Phoenix Inc., 800 Wisconsin Ave., Eau Claire, WI:  Employer
removed part of the seat belt from a Hyster powered industrial truck used
to work
on the loading dock.
Among other methods, one feasible and acceptable abatement method to
correct this hazard (1)
is to check the condition and operation of the seat belt and the mounts;
and/or (2) follow
American National Standards Institute (ANSI) Standard B56.1-1969 Safety
standard for Powered
Industrial Trucks which requires employers to have operators of powered
industrial truck which
are equipped with operator restraint devices or seat belts to use those
devices.
