Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from operating unrated underhung overhead hoist lifting devices. (a)Duro Standard Products Company & 486 Baer Drive, Hudson, WI 54016: The employer did not ensure the underhung hoist and supporting structure involving the I-beam, cable assembly, hoist, pivot pin, and structural welds to the columns, were designed to withstand the loads and forces imposed under normal operating conditions. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to follow ASME B30.16-1993, The American Society of Mechanical Engineers-An American National Standard- Standard for Overhead Hoists (Underhung) associated with Section 16-1.2-Construction. 16-1.2.1 Mechanical Design (a)The hoist and appurtenances shall be designed to withstand all stresses imposed under normal operating conditions while handling loads within the rated load (capacity). Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement Certification Letter")
