Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious burns from potential dust deflagration, explosion, or other fire hazards as a result of improper design of the dust collection systems: (a)Reclaimed Rustic Woodworks, N11067 Cty Road F, Phillips, WI: The following deficiencies were found with the dust collection system used throughout the main shop: (1)A means of tramp metal protection was not provided to keep any wanted metal fragments out of the air material separator associated with the system. (2)The dust collection system was located inside the building, in a means of egress. (3)A spark detection system with high speed abort gate or extinguishment capacity was not installed downstream of the last material entry point and upstream of the air-material separator where machinery such as the automated sander having a history of producing sparks having an automated feed system was used. (4)Deflagration isolation or suppression systems were not provided for the inlet (dirty air) side of the air-material separator. (5)Multiple dampers, gates, and orifice plates provided for the purpose of attempting to balance air flow in the system were not fastened in pace to prevent inadvertent movement. Abatement Notes: I.Among other methods, one feasible and acceptable means of abatement would be to comply with the guidelines outlined in the National Fire Protection Association's (NFPA) Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities, (Standard # 664), 2007 ed. II.Abatement Certification and Documentation are required for this item.
