Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Facility - On or about 10/24/2003, employees were exposed to being caught in between/crushing hazards from operating forklift trucks, including but not limited to the #8 CATERPILLAR (V5OE59G00467), without wearing installed seat belts in accordance with paragraph 7.39 section (a) of American Society of Mechanical Engineers (ASME) Publication B56.1-1993. Among other methods, one feasible and acceptable abatement method to correct this hazard includes but is not limited to training, certifying, and inspecting the wearing of installed seat belts by forklift operators operating forklift trucks. ABATEMENT CERTIFICATION REQUIRED
