Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to broken legs: Jobsite: The wall, which consisted of individual cement blocks, was not braced, secured, or other equivalent means of protection provided to prevent the wall from collapsing or each individual cement block from being displaced. Consequently, on or about 29 April 2004 an individual cement block fell on an employee's leg causing a compound fracture.
