Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:  Employees were
exposed to fall hazards due to improper guarding of elevator shaft
openings on all levels of the
freight elevator.
(a)On or about October 30, 2003, the freight elevator opening on the first
floor level
was not provided with a safety gate or door that complied with the
requirements
of ANSI A17.1-1971, Rule 204.6b, thereby exposing employees to the hazards
associated with falls.
Feasible Means of Abatement: Replace current gate with a gate or door that
extends no more than one inch above the car floor to a point at least 6
feet above
the car floor.
Certification, and documentation/evidence of abatement is required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
