Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)At the worksite at 161 West Wisconsin Ave., Milwaukee, WI 53203, the electrical worker was drilling holes in the side of the building from the JLG extending boom platform (self-propelled) and had no personal fall arrest system. The electrical worker was wearing a full body harness and had a shock absorbing lanyard attached to the full body harness but the lanyard was not attached to the basket of the manlift. Among feasible abatement would be to comply with the American National Standards Institute (ANSI) A92.5 - 1992 Standard for Boom- Supported Elevating Platforms and have employees wear fall arrest equipment whenever they are in an aerial lift. Without such protective equipment the worker was exposed to the hazard of falling to the concrete about 32 feet below. (b)At the worksite at 161 West Wisconsin Ave., Milwaukee, WI 53203, the electrical worker was drilling holes in the side of the building from the JLG extending boom platform (self-propelled) and while at the working level of about 32 feet he left the manlift basket and crawled into an open window of the third floor of the building. Among feasible abatement would be to comply with the American National Standards Institute (ANSI) A92.5 - 1992 Standard for Boom- Supported Elevating Platforms and have employees wear fall arrest equipment whenever they are in an aerial lift. Without such protective equipment the worker was exposed to the hazard of falling to the concrete about 32 feet below. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
