Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a load suspended by an overhead hoist: Throughout the facility, on or about July 22, 2004, overhead hoists were not inspected on a frequent and regular basis and adequately maintained in that no frequent nor periodic inspections were done and deficienices were noted in the Washing Department in the spliced wiring to the pendant control of the overhead hoist there as well as a lack of any strain relief for the electrical to that control. Among other methods, one feasible and acceptable method to correct this hazard is to: Conduct frequent and periodic inspections of the hoists for wear, deterioration, malfunction as per ANSI/ASME B30.16-1993 Section 16-2.1. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
