Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or struck-by hazards in the event of hoist failure: The CM Value Star Electric Hoist used by employees to hoist loads did not have: 1.Proper labeling or marking to identify the lifting capacity of the hoist clearly marked on the hoist. 2.A hook that included a safety latch. 3.Proper inspections being completed on a frequent or periodic basis. Among others feasible abatement includes but is not limited to: 1. Marking the lifting capacity of the hoist in accordance with American Standard of Mechanical Engineers Standard (ASME) B30.16-1-1-4(b)(1) 2.Installation of a safety latch on the hook in accordance with ASME B30.16-1.2.9. 3.Establishment of an inspection program in accordance with ASME B30, Chapter 16-2. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
