Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to asphyxiation while cutting an 18 inch diameter hole/plug from an existing storm sewer manhole. (a)At 861 East Wisconsin Avenue in Oconomowoc, WI, a storm sewer manhole approximately 7 1/2 feet deep, the employer did not conduct an initial survey of the operation to identify the space and the appropriate work procedures. No initial atmospheric testing was performed prior to entry and no attendant was stationed outside the permit required confined space while an entrant performed work in the storm sewer manhole. Among other methods, a feasible and acceptable method to correct this hazard is to follow the American National Standards Institute, (ANSI) Z117.1-2003; Safety Requirements for Confined Spaces as applicable. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
