Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards of approximately 10 feet or greater while working from the personnel work platform: (a)Warehouse Area. The personnel work platform, used on the forks of lift trucks to raise personnel in the air, has no midrail on two ends where employees enter and exit the platform, on or about July 21, 2005. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS to install a midrail approximately 21 inches in height in accordance with ASME B56.1-2000, Safety Standard for Low Lift and High Lift Trucks, Section 7.36.1. To provide an access opening, the guard rail may be hinged or removable, or chains may be used if proper positioning is easily accomplished and a secured condition is discernible. Guard rails and access opening guards shall be capable of withstanding a concentrated horizontal force of 890 N (200 lb) applied at the point of least resistance without permanent deformation.
