KRS 338.031(1): The employer did not furnish each of his employees employment which was free from recognized hazards that are causing or are likely to cause death or serious physical harm: a.Employees in the intake area were exposed to loose or unsecured bricks falling from the Southwest wall of the detention center. The hazard is that the falling brick could strike an employee. One feasible and acceptable abatement method to correct this hazard would be to control access to the area until the bricks can properly be secured. The employer recognized the hazard and initiated preliminary attempts at abatement by seeking bids for the repair of the brick.
