Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling from an elevation while working on
the forks of a forklift
truck:
(a) Heat Treat Area- On or about September 29, 2003, an employee stood on
top
of the forks
of the fork lift truck and was being raised to do maintenance work. The
fork surface did not
provide non-slip, suitable and stable surface on which to stand on and did
not have guard rails
to protect the employee from falling, nor was the employee tethered.
Among other methods, one feasible and acceptable method to correct this
hazard is the use
of a commercially manufactured safety basket that is specifically designed
for use on a fork
lift and meets the requirements of American National Standard Institute
(ANSI) B56.1-
2000.
No abatement certification or documentation is required for this item.
