Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing o r likely to cause death or serious physical harm to employees in that: The emplo yer failed to ensure that riders were not allowed to occupy equipment designed f or operators only: a.At or around the parking lot at 1301 N. Green Valley Pkwy., two employees rode a John Deere 210 LE Landscape Loader that was designed for t he occupancy of the operator only. The rider was subjected to potential serious injury or death if thrown off of the machine. Reference: John Deere 210 LE Lands cape Loader Operators Manual, Section: Driving the Machine, page 30-2. CAUTION: Only allow the operator on machine. Keep riders off. One feasible and acceptable method of abatement, among others, would be for the employer to ensure that employees were adequately trained prior to operating assigned equipm ent. Specific safety-related instructions (i.e., caution, danger) in the equipme nt operators manual should be included when training employees.
