Nevada Revised Statute 618.375(1):  The employer did not furnish
employment and a place of
employment which were free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees in that:
The employer did not ensure that the employee was not exposed to a fall
hazard, as follows:
a.The employee was not continuously using his personal fall resistant
equipment in
such a matter to be anchored within guardrail system of the aerial
platform lift
(JIB PLUS, Model#: E400AJP and Ahern Rental#: 25887).  The employee
climbed onto the midrail and toprail of the guardrail system to exit the
aerial
platform lift at the casino 3rd floor level, east center hoistway opening
of the low
rise, Belliago Spa Tower.  The employee was exposed to a fall hazard of
approximately 12 feet.

wearing fall protection devices and other safety gear as required at all
times and
.8.10.1 - Personnel shall maintain a firm footing on the platform floor
while
working therein.  See attached copy.
One feasible and acceptable method of abatement, among others, would be to
ensure that all users of the aerial platform lift are instructed relating
to proper use
and fall protection.
