Nevada Revised Statute 618.375(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer failed to ensure that the employees were provided a workplace free from recognized hazards causing or likely to cause death, as follows: a.The employer failed to provide effective temporary traffic control protective measures to protect the landscaping crew working adjacent to the 2500 block of Buffalo Drive. The employees had been dropped off at the work site by the foreman and given traffic cones to temporarily close down the right hand traffic lane adjacent to the work area. One member of the work crew was fatally injured and another was seriously injured when struck by a vehicle. References: American National Standards Institute (ANSI) D6.1- 1993, Manual on Uniform Traffic Control Devices (MUTCD) Section 6B (Fundamental Principles) states, "traffic control devices used on street and highway construction, maintenance, utility, or incident management (temporary traffic control) operations shall conform to the applicable specifications of this manual." One acceptable method of abatement, among others, is to follow the MUTCD as noted above.
